Agreement to these terms

These Terms of Service ("Terms") govern your use of the Anniversary Gifts website and your purchase of products offered through it. By accessing the site or placing an order, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the site or submit an order.

About our service

Anniversary Gifts provides an online storefront for anniversary flowers and related gift content. We are an affiliate of FloristOne / Florist 1 LLP. We do not operate a local florist, employ delivery drivers for flower orders, or guarantee that a specific local florist will fulfill any order.

Flower orders are fulfilled through our florist network partner and its subcontractors. Product descriptions, images, and pricing for flowers are supplied through the Provider's API and promotional materials.

Eligibility and delivery area

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. Flower delivery is offered only to addresses in the United States and Canada where the Provider's network supports delivery. Availability, delivery dates, and fees are shown at checkout.

Orders and fulfillment

When you submit an order, you authorize us to transmit your order details and payment token to our florist network partner for processing. An order is not complete until the Provider accepts it. You may receive an on-screen confirmation from us and a separate confirmation email from the Provider or its network.

For flower orders, the Provider is responsible for order acceptance, payment collection (through its authorized payment flow), fulfillment, delivery, customer service, credits, and refunds, except where our own website errors cause a problem we are responsible for under applicable law or our agreements.

Pricing and payment

Prices, delivery charges, taxes, and order totals displayed at checkout come from the Provider's API for live orders. We do not add hidden markups or discounts to the flower amount transmitted to the Provider. You agree to pay the total shown at checkout.

Payment is processed through Authorize.net using tokenized card data. By submitting payment information, you represent that you are authorized to use the payment method provided.

Delivery, substitutions, and product quality

Delivery dates are estimates based on information available at checkout. Fresh floral products are subject to seasonal availability. The fulfilling florist may make reasonable substitutions of equal or greater value if a shown item is unavailable.

We do not make delivery guarantees, freshness guarantees, or refund promises beyond what the Provider's policies and applicable law provide. Do not rely on statements not shown at checkout or in Provider materials.

Cancellations, changes, and refunds

Cancellation and modification policies depend on order status and the Provider's rules. Contact the support channels identified in your order confirmation email as soon as possible for order-related requests.

Refunds, credits, and chargebacks for flower orders are handled according to the Provider's policies and your card issuer's rules. We may assist with technical issues caused by our website but cannot override Provider fulfillment decisions except as required by law.

Acceptable use

• Provide accurate delivery and billing information.
• Use the site only for lawful purposes.
• Do not attempt to interfere with checkout, pricing, API integrations, or site security.
• Do not scrape, reverse engineer, or misuse Provider content or systems except through approved API use on our site.
• Do not misrepresent your relationship with us or the Provider.

Intellectual property

Site branding, layout, and original content are owned by us or our licensors. FloristOne product images, descriptions, pricing, and marks are Provider Content licensed for use through our affiliate and API agreements. You may not copy, modify, or redistribute Provider materials except as permitted through normal use of the site.

Disclaimers

The site and products are provided "as is" and "as available" to the fullest extent permitted by law. We disclaim warranties not required by applicable consumer protection laws, including implied warranties of merchantability and fitness for a particular purpose where disclaimers are allowed.

We are not responsible for acts or omissions of the Provider, local florists, payment networks, or carriers except as required by law.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the site or any order — except where such limitations are prohibited (including certain consumer rights in the United States and Canada).

Our total liability for any claim relating to the site or an order is limited to the amount you paid for the specific order giving rise to the claim, except where a higher limit is required by law.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the site, violation of these Terms, or provision of inaccurate information, except to the extent caused by our negligence or willful misconduct.

Disputes and governing law

These Terms are governed by the laws of the United States and applicable state law where we operate, without regard to conflict-of-law rules, except that mandatory consumer protection laws in your state or province may apply to you and cannot be waived.

If you are in Canada, you retain rights under applicable provincial consumer protection legislation. Where required, disputes may be brought in the courts of your province of residence for consumer matters.

Changes

We may update these Terms from time to time. The revised Terms take effect when posted on this page with an updated date. Your continued use of the site or placement of orders after changes constitutes acceptance.
